    \u00a0<\/strong>1. Scope of Application<\/strong><\/p>

    1.1. These General Terms and Conditions apply to all contracts between Sarah Tabola, Am Schafsteg 2, 64569 Nauheim (hereinafter referred to as the \u201cProvider\u201d), and her customers regarding the purchase of digital content and the booking of services delivered online.<\/p>

    1.2. The offer is directed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for purposes that can be attributed neither to their commercial nor to their independent professional activity.<\/p>

    1.3. Deviating terms and conditions of the customer shall not apply unless the provider expressly agrees to their applicability.<\/p>

    2. Services and Offers<\/strong><\/p>

    2.1. The Provider offers digital content for download as well as services provided online and on-site. These include, in particular:<\/p>

    • Digital content such as PDF files, audio files and similar materials,<\/li>
    • Individual consultations and coaching,<\/li>
    • Online seminars,<\/li>
    • Online yoga offerings,<\/li>
    • Individually arranged in-person consultations, coaching sessions, workshops, and yoga offerings.<\/li><\/ul>

      2.2. The specific nature, scope, execution, and date\u2014as well as, where applicable, the location\u2014of the respective service are determined by the relevant offer description or the individual agreement with the customer.<\/p>

      2.3. The presentation of the offers on the website does not constitute a legally binding offer, but rather an invitation to the customer to submit a binding offer to conclude a contract.<\/p>

      3. Ordering Process and Conclusion of Contract<\/strong><\/p>

      3.1. The customer can select the desired products or services and collect them in a shopping cart using the \u201cAdd to cart\u201d button.<\/p>

      3.2. In the shopping cart, the customer can review, modify, or remove their selection. Clicking the \u201cProceed to Checkout\u201d button takes the customer to the final stage of the ordering process.<\/p>

      3.3. Before completing the order, the customer can review and correct their details.<\/p>

      3.4. By clicking the \u201cOrder with obligation to pay\u201d button, the customer submits a binding offer to conclude a contract for the selected digital content or services.<\/p>

      3.5. The contract is concluded as soon as the provider accepts the customer's offer.<\/p>

      In the case of digital content, acceptance occurs no later than when the digital content is made available for download or access is enabled.<\/p>

      For services that can be booked online, acceptance occurs no later than the confirmation of the booked appointment or event.<\/p>

      In the case of individually agreed services\u2014particularly in-person appointments\u2014the contract is concluded through the express agreement between the provider and the customer.<\/p>

      3.6. If the customer's offer is not accepted within a reasonable period, no contract is concluded.<\/p>

      4. Prices and Terms of Payment<\/strong><\/p>

      4.1. All prices stated are final prices. Due to the application of the small business regulation pursuant to Section 19 of the German Value Added Tax Act (UStG), no VAT is charged or shown.<\/p>

      4.2. The available payment methods are displayed to the customer during the ordering or booking process.<\/p>

      4.3. Payment is processed via the payment service provider PayPal. The invoice amount is due immediately upon conclusion of the contract, unless otherwise specified in the respective offer.<\/p>

      4.5. When booking online appointments, seminars, or yoga sessions, the appointment is only confirmed once payment has been successfully received.<\/p>

      5. Provision of digital content and performance of online services<\/strong><\/p>

      5.1. Digital content is made available automatically upon successful completion of the ordering process and receipt of full payment.<\/p>

      5.2. The customer receives access to digital content via email and\u2014provided a customer account exists\u2014can also access it via the customer account.<\/p>

      5.3. The duration of access to digital content is determined by the respective offer description.<\/p>

      5.4. The customer is responsible for ensuring the technical prerequisites for using the digital content and online services. This includes, in particular, a suitable internet connection and a suitable end device.<\/p>

      5.5. Online services are carried out at the booked time or on the specified event date.<\/p>

      5.6. Online services are provided via a suitable online service\u2014such as Zoom, Google Meet, Microsoft Teams, or comparable services\u2014or, where applicable, via WhatsApp video call. Access links are provided to the customer as part of the booking confirmation via the booking system or by email (except in the case of WhatsApp video calls).<\/p>

      5.7. Online seminars and online yoga classes are conducted live. Recordings are not made unless explicitly stated otherwise.<\/p>

      5.8. Services performed on-site are not booked via the online shop. Arrangements for the provision of an on-site service are made individually between the provider and the customer. Details\u2014specifically the date, location, and scope of the service\u2014are agreed upon separately.<\/p>

      6. <\/strong>Booking, rescheduling, and cancellation of online services<\/strong><\/p>

      6.1. For individual appointments and specific online offerings, the customer selects an available appointment via our booking system (Amelia).<\/p>

      6.2. Cancellation and rebooking by the customer:<\/p>

      • 1:1 appointments (individual sessions): Clients may cancel or request to reschedule free of charge up to 24 hours before the scheduled appointment.<\/li>
      • Seminars and workshops: Cancellations or rebookings free of charge are possible up to 7 days before the event date.<\/li><\/ul>

        6.3. Cancellations or rebookings must be made via the booking system or by email.<\/p>

        6.4. In the event of a cancellation after the specified deadlines have expired or if the customer fails to appear for the scheduled appointment, the provider\u2019s claim to remuneration remains valid in full. The customer reserves the right to prove that the provider incurred no loss or a significantly lower loss.<\/p>

        6.5. Should the provider need to cancel a scheduled appointment for a valid reason (e.g., illness), a substitute appointment will be offered. If no substitute appointment can be arranged, any payments already made will be refunded in full.<\/p>

        7. Customer Account and Guest Order<\/strong><\/p>

        7.1. Orders can be placed either as a guest or by creating a customer account. In the case of a guest order, the data required to process the contract is processed on a one-off basis without a permanent user account being created. For guest orders, the customer accesses purchased digital content via the links provided during the ordering process as well as via email.<\/p>

        7.2. The customer can view their orders and access purchased digital content via the customer account.<\/p>

        7.3. The customer undertakes to provide truthful information when creating the customer account and to update it in the event of changes.<\/p>

        7.4. Access credentials for the customer account must be treated confidentially and must not be disclosed to third parties.<\/p>

        7.5. The customer may request the deletion of their customer account at any time. Statutory retention obligations remain unaffected by this.<\/p>

        8. Rights of use regarding digital content<\/strong><\/p>

        8.1. The digital content provided by the Provider is protected by copyright.<\/p>

        8.2. The customer receives a non-exclusive, non-transferable right to the personal use of the acquired content.<\/p>

        8.3. Passing the content on to third parties, publishing, reproducing, or making it publicly accessible is not permitted.<\/p>

        8.4. Commercial use of the digital content is excluded unless expressly agreed otherwise.<\/p>

        9. Information on consultations, coaching, seminars and online yoga<\/strong><\/p>

        9.1. The services offered serve to provide information, support, personal development, and, in the case of yoga offerings, guidance on movement and yoga exercises.<\/p>

        9.2. The Provider does not guarantee that participation in consultations, coaching sessions, seminars, or yoga offerings will result in any specific personal, health-related, or other success.<\/p>

        9.3. Participation in online yoga sessions takes place with due regard for one\u2019s own physical condition. The customer decides for themselves which exercises are appropriate for their own physical situation.<\/p>

        9.4. In the event of health issues, limitations, or uncertainty regarding participation in or the performance of certain exercises, the customer should seek medical advice if necessary.<\/p>

        9.5. The customer is obliged to pay attention to their own physical signals and to stop exercises in the event of pain, discomfort, or overexertion.<\/p>

        10. Warranty<\/strong><\/p>

        10.1. Statutory warranty rights apply.<\/p>

        10.2. The Provider points out that technical requirements on the part of the customer may be necessary for digital content. The customer is responsible for meeting these requirements.<\/p>

        11. Liability<\/strong><\/p>

        11.1. The Provider shall be liable without limitation for damages resulting from willful intent or gross negligence, as well as for damages resulting from injury to life, body, or health.<\/p>

        11.2. In the event of a slightly negligent breach of essential contractual obligations, the Provider shall be liable only for foreseeable damage typical of the contract.<\/p>

        11.3. Otherwise, liability is excluded to the extent permitted by law.<\/p>

        11.4. The limitations of liability also apply for the benefit of the Provider\u2019s legal representatives and agents.<\/p>

        12. Storage of the contract text<\/strong><\/p>

        12.1. The contract data is stored as part of the ordering process.<\/p>

        12.2. After completing the order, the customer will receive an order confirmation via email containing the essential contract information, the applicable General Terms and Conditions, and the instructions on the right of withdrawal.<\/p>

        12.3. If a customer account exists, the customer can view their orders there.<\/p>

        13. Final Provisions<\/strong><\/p>

        13.1. The law of the Federal Republic of Germany applies, excluding the UN Sales Convention.<\/p>

        13.2. The language of the contract is German.<\/p>
